Plant varieties, except algae, bacteria and fungi, which are new, distinct, stable and homogeneous, may be entitled to protection in New Zealand under the Plant Variety Rights Act.
The grant of a plant variety gives the grantee the exclusive right to produce, sell, propagate and authorise others to produce, sell and propagate the variety concerned.
